Instructor terms

These terms govern the publication of courses on Mudey Formation by an instructor. They complement the terms and conditions, which remain applicable to all users, instructors included.

By activating the instructor role on your account, you accept these terms. In case of conflict, the instructor-specific provisions prevail as regards the publication of content.

The instructor role is activated from your account after accepting these terms. We may refuse or withdraw that access, with reasons given, in particular in case of manifestly illegal content, plagiarism or repeated breach of these terms.

• •You must be of legal age and have the legal capacity to contract.
• •The information on your public profile must be accurate and kept up to date.
• •An instructor account is personal: it may not be lent, shared or transferred.

You are solely responsible for the courses you publish: outline, videos, texts, downloadable resources and exchanges with learners.

• •The content must match the description and objectives announced on the course page.
• •It must be accurate, up to date and free of discriminatory, defamatory or hateful statements.
• •It must contain no personal data of third parties without a legal basis, and no pornographic or violent content.
• •Promises of guaranteed results, income or success are prohibited.
• •Reselling content for which you do not hold the rights is strictly prohibited.

You keep all intellectual property rights in the content you publish.

You grant Espero-Soft Informatiques SRL a non-exclusive, worldwide, royalty-free licence to reproduce, host, technically adapt and distribute that content on the platform and its applications, for as long as it stays online and for the time needed to serve the access already sold.

This licence also covers the use of excerpts, of the promotional video and of the cover image to promote the course on the platform, in our communications and on our social networks.

You warrant that you hold all rights required for the published content, including images, music and excerpts used, and you indemnify us against any third-party claim in that respect.

The public price of your courses is agreed jointly and displayed inclusive of all taxes. We may run occasional promotional campaigns, never below a floor agreed with you.

• •The revenue share is set in the instructor agreement provided when the role is activated.
• •Revenue is calculated on the amount actually collected excluding taxes, after payment fees and refunds.
• •Payment is made once the withdrawal and guarantee periods applicable to the purchases concerned have expired.
• •You are responsible for your tax and social obligations in your country of residence.

Learners buy lifetime access: you undertake to keep your course available and to correct reported errors within a reasonable time.

• •Answer learners' questions within a reasonable time and courteously.
• •Flag any content that has become outdated and either update it or state it clearly.
• •Do not divert learners to another sales channel from within the lessons.

You may unpublish a course at any time: it then disappears from the catalogue. Learners who already bought it keep their access, in line with the lifetime access promised at purchase.

We may remove a course, after informing you, in case of illegal content, serious breach of these terms, or a substantiated notice within the meaning of Regulation (EU) 2022/2065 on digital services.

Either party may end the collaboration at any time by written notice. Access already sold is honoured and revenue due is paid to you on the usual schedule.

In case of serious breach, in particular manifestly illegal content, suspension may be immediate. It is notified to you with its reasons and you may contest it by writing to us.

The platform is provided as is, with a best-efforts obligation as to availability. We guarantee neither a sales volume, nor a particular search ranking, nor the permanence of a feature.

You are liable for damage caused to learners or third parties by your content. Our liability may only be engaged for direct damage attributable to us.

These terms are governed by Belgian law. The courts of the judicial district of Brussels have jurisdiction, subject to mandatory rules applicable to consumers.
